Disclaimer & Terms of Delivery

Acceptance of Terms

By placing an order, the Customer agrees to these Terms and assumes all risk and liability associated with delivery, placement, and use of materials. Palmetto Sand & Gravel LLC (“the Company”) is not a licensed building contractor. Any suggested uses are based on common applications. Customers must consult a licensed contractor and comply with all local building codes and regulations.

Delivery Site Requirements & Liability

  • The Customer must ensure delivery access is safe and suitable for large trucks capable of carrying up to 22 tons per load.

  • If access is obstructed or unsafe (e.g., soft ground, low clearance, narrow driveways), the driver may unload at the nearest safe location or refuse delivery.

  • If delivery cannot be made due to site conditions, a missed delivery fee may apply.

  • The Customer assumes full liability for damages resulting from placement outside the curb line, on public property, or on third-party property. Any fines, damages, or claims are the Customer’s responsibility.

Product Size & Color Variance

  • Aggregates are natural materials; expect up to 10% variance in size and up to 10% fine material (dust).

  • Color may differ from online or printed images due to moisture, quarry variations, and weather conditions.

Product Volume

  • Because materials are loaded in bulk, quantities may vary:

    • ±20% for orders under 4 tons

    • ±10% for orders of 4 tons or more

  • On large full-truck orders, variance is minimal.

Unloading & Property Damage

  • Materials will be offloaded at the Customer’s designated area on firm ground such as concrete, asphalt, or dry compacted soil.

  • Palmetto Sand & Gravel LLC is not responsible for property damage caused by truck weight or unloading. This includes cracking driveways, rutting soil, damaging landscaping, or harming underground utilities.

  • Customers are responsible for promptly moving materials if placed in a roadway, easement, or public right-of-way.

Debris & Road Spray

  • Trucks are tarped per DOT requirements; however, Palmetto Sand & Gravel LLC is not liable for gravel, dust, or debris that may escape during transit or unloading.

Insurance

  • Palmetto Sand & Gravel LLC carries commercial liability and auto insurance as required by law.

  • The Company does not carry cargo insurance or pollution/spillage coverage.

  • The Customer assumes all risk of material loss, spillage, or contamination after loading and unloading.

Wait Time & Fees

  • Deliveries include a 30-minute free grace period.

  • After that, a $50 fee applies for each additional 30 minutes of waiting caused by site delays.

Tailgate Spreading

  • Tailgate spreading is available on request at no additional charge.

  • Because material flow varies, uniform spreading is not guaranteed.

Cancellation and Refund Policy

Demolition Haul Away

  • A 24-hour cancellation notice is required for all demolition removal work in order to receive a full refund.

  • Same-day cancellations are subject to a $200 cancellation fee.

  • If our trucks arrive at the job site, a 4-hour minimum charge applies and is non-refundable, regardless of whether material is hauled away.

Aggregate Materials

  • A 24-hour cancellation notice is required for all aggregate material orders.

  • If our trucks have already arrived at the plant but have not been loaded, a $200 travel-time fee applies.

  • If material has been loaded, the order is considered non-refundable because once loaded, aggregate is considered “contaminated” and cannot be returned to the plant.

Indemnification

The Customer agrees to indemnify and hold Palmetto Sand & Gravel LLC harmless from any claims, damages, or penalties arising from delivery placement, site conditions, or use of materials.

Updates & Governing Law

  • These Terms may be updated at any time; the version in effect at the time of order applies.

  • All agreements are governed by the laws of the State of South Carolina
